Please read the following Terms and Conditions prior to the use of this website. By using our website, you hereby agree to the Terms and Conditions imposed hereon, whether as a guest or registered user, indicating that you accept these terms of use and that you agree to abide by them. We reserve the right to make some changes in these Terms and Conditions from time to time without prior notice. You are responsible for regularly reviewing these Terms and Conditions for any changes, and you agree to abide by them.

BrightBrands.ph is operated by BrightBrands Inc., a company duly organized and registered with
the Securities and Exchange Commission of the Philippines, with Company Registration No. CS201605535
and principal office located at Topy’s Place Commercial Building G/F Calle Industria cor. Economia Street,
Bagumbayan, Quezon City, 1110. The corporation is likewise duly registered with the Bureau of Internal
Revenue, with TIN Number 009-252-422-000.
You shall also be responsible for all the transactions that are made under your account or password.
BrightBrands.ph reserves the right to refuse registration, terminate accounts, or cancel orders at any
time and for any reason including your failure to comply with any of the provisions of these Terms and Conditions.
You must not use our website in any way that causes, or may cause, damage to the website or impairment
of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent
or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
Products Information and Pricing
BrightBrands.ph carries various goods, such as but not limited to, the following: nail polish for kids,
lunchbox containers and lunch bags, food & sandwich cutters, bento food picks, water bottles, books,
activity sets, and other various and essential items. BrightBrands.ph provides product information and reviews,
such as on the nature, quality and quantity of the product, but does not warrant that the information and
reviews are accurate, complete, reliable, and free of errors. Materials are provided for product information
purposes only and it shall not give rise to any commitment or obligation by us, nor shall it constitute any
part of an offer or contract.
We assure that every possible effort is made to display accuracy and detailing of all colors to all
products that appear on BrightBrands.ph. However, as screen calibrations may vary, we cannot guarantee
that your screen’s display of any color will be 100% accurate.
The prices reflected on this website represent the full retail price, inclusive of tax and other applicable
charges, subject to change without prior notice. Product prices and delivery charges may change at any time,
but such changes will not affect orders in respect of which we have already sent you an Order Confirmation.
Despite our best efforts, a small number of the items on our website may be mispriced. Should there be any
price discrepancies, we will contact you and ask for your confirmation on whether to proceed with the order
at the amended price or to cancel your order.
Order and Acceptance
All orders are subject to processing and availability. Before placing an order, you must first be registered with BrightBrands.ph. To order, you must follow the instructions carefully and review the details of your prospective order before submission. After which, you will receive an email from us acknowledging receipt and acceptance of your order. The contract between us will only be formed when we send you the confirmation email. You may no longer change or modify your order once the confirmation email is sent to you. If you wish to change your purchase, you may contact us at sales@brightbrands.ph for assistance. This contract will only be limited to those orders we have confirmed in the acknowledgement email.
Payment Methods
Payment for all Products must be made using any payment methods available onsite upon “checkout” within the Site.
Delivery and Shipping
Orders are processed daily from Monday to Friday. All orders placed after 04:00 PM during Fridays, weekends and
holidays will be processed on the next business day. Once your order has been processed, you will be provided with
an order tracking number, which will be indicated in the confirmation or acknowledgment email that will be sent to you.
BrightBrands.ph will deliver the products to the address you provide at the time of order. You may check your order
status with the tracking number provided to you. Your orders will be prepared for shipping once it has been processed
and confirmed by our system. A confirmation email will be sent to you with your order details once the products have
been shipped or handed over to our partner courier. We do not allow address changes after an order has been accepted
and confirmed by us. Delivery times may vary based on location and availability of the product. Any delivery times
quoted are estimates only and BrightBrands.ph will not be liable for any delays in delivery.
We will be deemed to have delivered the product/s to you when we deliver them to the address you gave us when
placing the order or signing up on our Site.
BrightBrands.ph operates only in the Philippines; delivery addresses outside of the country will not be processed.
The delivery address must be located within key cities in the Philippines. We may not be able to deliver to certain
locations that have restricted access or considered as out-of-delivery zone. Additional charges may apply on areas
considered as out-of-delivery zone.
The delivery of your purchased Product/s will take place between Monday to Friday within normal business hours
(except weekends and public holidays).
Expected delivery of orders shipped are as follows:
- Metro Manila 3 - 5 working days
- Luzon 5 - 7 working days
- Visayas 5 - 7 working days
- Mindanao 5 - 7 working days
- Out-of-Delivery Zone (ODZ) additional 5 - 7 working days
- Peak Season (Oct-Jan) additional 1 - 2 working days
Return and Exchange Policy
At BrightBrands.ph, customer satisfaction is our priority. We gladly accept returns and exchanges within 3 days of the delivery date, provided the following conditions are met:

Eligibility
- Sale items are final sale and cannot be returned or exchanged.
- Items must be returned in their original packaging, including gift boxes, product boxes, and bags, with all tags/labels attached.
- Items must be unworn, unused, unaltered, and unwashed.
Note: BrightBrands.ph reserves the right to reject returns that do not meet these criteria.

Return Process
- Email us at sales@brightbrands.ph with the subject line “Return” and include photos and/or videos of the package and its contents.
- Once your return request is reviewed and approved, we will provide you with instructions, including the return shipping address.

Shipping Fees
- Customers are responsible for return shipping fees unless the return is due to an error on our part (e.g., incorrect size, color, or item shipped).
- For exchanges, the customer is also responsible for the shipping cost of the new item.

Refund and Exchange Options
- If the requested exchange item (color, size, or design) is unavailable, we will issue a refund in the form of store credit or shopping vouchers.
- Refunds or credits will be processed within 7 business days of receiving the returned item and verifying its condition.

Processing Time
- All return and exchange requests are processed within 7 business days of receiving the request.

Important Notes
- Items not meeting the return criteria will be sent back to the customer at their expense.
- BrightBrands.ph reserves the right to update this policy as needed to comply with applicable laws and ensure fairness to all parties.
Product Warranties
Only defective products purchased from our Site can be returned or exchanged within 7 days from the Product’s delivery date to the customer.

If we determine, at our sole discretion, that the purchased Product is defective, you will be eligible to exchange your Product. We reserve the right to test your allegedly defective product(s).
If the product is deemed by our Technical Support NOT to be defective, our standard product warranty will apply. Shipping fees shall be shouldered by the customer.
If the condition of the product is misrepresented by the customer, our standard product warranty will apply and we may impose corresponding fees.

Intellectual Property
All content included on this site, such as text, graphics, logos, images, and software, is the property of BrightBrands.ph or its content suppliers and protected by intellectual property laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the site without express written permission from BrightBrands.ph.
Warranties
We do not warrant the completeness or accuracy of the information published on this website; nor do we commit to ensuring
that the website remains available or that the material on the website is kept up-to-date.
To the full extent permissible by the applicable law, BrightBrands.ph disclaims all warranties, express or implied,
including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
BrightBrands.ph does not warrant that information, content, materials, products and other services included made available
to you or electronic communications sent from BrightBrands.ph are free from viruses and harmful components. BrightBrands.ph
will not be held liable for any damages arising from the use of its website.
Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting
from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our
or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that
may not be excluded under applicable law.
Indemnity
Without prejudice to our other rights under these terms and conditions, a breach in any way of these terms and conditions, shall allow us take such action as we deem appropriate, including but not limited to, suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website, and/or bringing court proceedings against you.
Limitation of Liability
BrightBrands.ph will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, lost profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our site by any third party.
Indemnification
You agree to indemnify, defend, and hold harmless BrightBrands.ph, its subsidiaries, affiliates, partners, officers, directors, interns and employees, agents, contractors, licensors, service providers, subcontractors, suppliers, from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to any violation of these Terms and Conditions or any activity related to your account.
Privacy and Data Collection
BrightBrands.ph adheres to Republic Act No. 10173, also known as the Data Policy Act of 2012. We shall therefore only gather and
use your name and other information related to our dealings with you
We shall retain your information only for as long as necessary for the fulfillment of the purposes for which the data was obtained,
for legitimate business purposes, or as provided by law.
BrightBrands.ph shall not share or disclose customers’ personal information, collected through this site, with third parties, except
to those BrightBrands.ph are in contract with to carry out its obligations. However, in exceptional circumstances, BrightBrands.ph
may be required to disclose your personal information on certain grounds and circumstances provided by law.
Without limiting the generality of the foregoing, we use Customer Data to, among others:
- Provide e-commerce services, including customer support;
- Enhance your customer experience and determine tailored content to meet your preferences and needs;
- Communicate relevant services and/or advisories to you;
- Abide by any safety, security, public service or legal requirements and processes;
- Process information for statistical, analytical, and research purposes.
We use your Personal Information to the extent necessary to comply with the requirements of the law and legal process, such as a
court order; to comply with a legal obligation; or to prevent imminent harm to public security, safety or order. We use your Non-Personal
Information for statistical, analytical, and research purposes to create anonymous and aggregate reports.
When required by our Privacy Policy and the law and before we use or process your Customer Data for any other purpose, we will ask for your consent.
We outsource or contract the processing of Customer Data to third parties, such as but not limited to, payment gateways, fraud systems,
vendors, service providers, partners or other platform operators, to fulfill any of the above purposes. They are only authorized to use
Customer Data for such contracted purposes. They may have access to Customer Data for a limited time under reasonable contractual and technical
safeguards to limit their use of such information. We require them to protect Customer Data consistent with our Privacy Policy.
BrightBrands.ph ensures that all information gathered are safely and securely stored and cannot be easily accessible to third parties.

Severability
In the event that any provision of this Agreement is declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable, it shall not affect the other provisions, which shall remain in full force and effect.

We reserve the sole right to update, change or replace any part of these Terms by posting updates and/or changes to our Site. It is your responsibility to check this Site periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.
Applicable Law and Dispute
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, whose courts shall have exclusive jurisdiction over all disputes arising in connection with this Agreement to the exclusion of all other courts and jurisdictions.
Entire Agreement
These Terms and any policies or operating rules posted by us on this Site constitutes the entire agreement and understanding between you and us and govern your use of the Site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Definition of Terms
- "Account" means the customer registration of username and password to be able to purchase from BrightBrands.ph.
- "Confirmation" means any order placed and accepted by BrightBrands.ph.
- "Credit Card" means any card, plate, coupon book, or other credit device existing for the purpose of obtaining money, property, labor, or services on credit.
- "Customer" means a natural or juridical person who is a purchaser of consumer products offered on this site
- "Defective product" means a product unfit for its intended use, or is infirmed that prevents an item from being complete, desirable, or fail in its purpose.
- "Product" means any item that is made or refined and then marketed/sold for a price.
- "Label, labeling" means the display of written, printed, or graphic matter on any product, its immediate container, tag, literature, or other suitable material affixed thereto for the purpose of giving information as to the identity, components, ingredients, attributes, directions for use, specifications, and such other information as may be required by law or regulations.
- "Package" or "packaging" means any container or wrapping in which any consumer product is enclosed for use in delivery or display of that consumer product to retail purchasers.
- "Person" means any individual, partnership, corporation, or association, trust, government, or governmental subdivision, or any other legal entity.
- "Trade name" or "Trademark" means the name or designation identifying or distinguishing an enterprise or any visible sign capable of distinguishing the goods of an enterprise and shall include a stamped or marked container of goods.
- "COP" or "Cash on Pick up" means a purchase option that allows for direct cash at office pick up, scheduled or walk-in.
- "You" means the user of the website.
